Terms & Conditions

1. Acceptance of Terms

By downloading, installing or using the Mind Mix application ("App") or website ("Site"), you ("User" or "Parent/Guardian") agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, do not use the App or Site.

These Terms apply to all users of the App, including parents and guardians who download the App for use by children under their supervision.

2. Licence to Use

Subject to these Terms, Dhara Vyas & H. Co. grants you a limited, non-exclusive, non-transferable, revocable licence to:

• Download and install the App on one or more Android devices owned or controlled by you
• Use the App for personal, non-commercial purposes only
• Access the website for informational purposes

This licence does not include the right to: sublicense, sell, resell, copy, reproduce or modify the App; decompile, reverse engineer or disassemble the App; create derivative works based on the App; or use the App for any commercial purpose.

3. Eligibility & Parental Consent

Mind Mix is designed for use by children under adult supervision. By downloading and allowing a child to use the App, you confirm that:

• You are the parent or legal guardian of any child under 18 who uses the App
• You consent to the child's use of the App in accordance with these Terms
• You understand that Mind Mix requires an active internet connection and may display advertisements in the free version
• You take responsibility for monitoring your child's use of the App in accordance with age-appropriate screen time guidelines

4. Premium Subscription

4.1 Subscription Details

Mind Mix offers an optional premium subscription ("Mind Mix Premium") that removes all advertisements from the App. Current pricing is ₹49 per month (Indian Rupees), billed monthly via Google Play Billing.

4.2 Auto-Renewal

The subscription automatically renews each month unless cancelled at least 24 hours before the end of the current billing period. Auto-renewal is managed by Google Play.

4.3 Cancellation

You can cancel your subscription at any time via: Google Play Store → My Account → Subscriptions → Mind Mix → Cancel. Cancellation takes effect at the end of the current billing period. No partial refunds are provided for unused subscription time, except where required by applicable law.

4.4 Refunds

Refund requests are handled in accordance with Google Play's refund policy. For technical issues, contact us at hardik.vishalpura@gmail.com and we will do our best to resolve any problems.

4.5 Price Changes

We reserve the right to change subscription pricing. We will provide at least 30 days notice of any price increase via the App or email (if you have provided one through Google Play).

5. Acceptable Use

You agree not to use the App or Site to:

• Violate any applicable laws or regulations
• Attempt to hack, probe or test the vulnerability of our systems
• Interfere with or disrupt the App's servers or networks
• Attempt to circumvent any security measures or copy protection
• Use automated tools or bots to access the App
• Misrepresent your identity or affiliation with any person or organisation

6. Intellectual Property

All content in Mind Mix including but not limited to game designs, graphics, illustrations, sound recordings, music, text, code, logos, trademarks and the Mind Mix brand is owned by Dhara Vyas & H. Co. or licensed to him.

Nothing in these Terms transfers any intellectual property rights to you. The licence granted in Section 2 is strictly limited to use of the App as described.

7. Disclaimer of Warranties

The App is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components. We do not guarantee specific educational outcomes from use of the App.

We make no warranties regarding the accuracy or completeness of any content in the App, including quiz questions, educational information or AI-generated content in Draw & Guess and Story Builder.

8. Limitation of Liability

To the maximum extent permitted by applicable law, Dhara Vyas & H. Co. shall not be liable for any indirect, incidental, special, consequential or punitive damages arising from your use of the App. Our total liability for any claim shall not exceed the amount you paid for the subscription in the 12 months preceding the claim (or ₹500, whichever is less, if no subscription was purchased).

9. Changes to the App

We reserve the right to modify, suspend or discontinue the App (or any part of it) at any time with or without notice. We may update game content, add or remove features, change subscription pricing (with notice) and modify these Terms. Continued use of the App after any changes constitutes acceptance of the updated Terms.

10. Termination

We may terminate or suspend your access to the App immediately, without notice, if you breach these Terms. Upon termination, your licence to use the App is immediately revoked. All provisions of these Terms that by their nature should survive termination shall continue to apply.

11. Governing Law & Dispute Resolution

These Terms are governed by the laws of India. Any disputes arising from these Terms or use of the App shall be subject to the exclusive jurisdiction of the courts of Ahmedabad, Gujarat, India.

Before initiating any legal proceedings, we encourage you to contact us at hardik.vishalpura@gmail.com to attempt to resolve the dispute informally. We are committed to resolving issues promptly and fairly.
